Distinguishing Different Cases of Applied Climatic Causation

This chapter builds heavily on the previous findings to demonstrate the feasibility of establishing causation in climate change litigation within different groups of cases. By drawing contrasts between various jurisdictions, actors and areas of law, it demonstrates how approaches to climatic causation alter within a number of different scenarios. Ultimately, this chapter lays the groundwork for parties in climate change litigation to overcome the hurdle of establishing causation and clarifies the requirements for its ultimate consideration.
