This study aims to delve into the significance of consultation as a crucial step taken by public administration before making administrative decisions. Numerous administrations rely on consultation as a preventive measure to steer clear of and minimize administrative errors during the decision-making process. The core issue addressed in this study revolves around determining the legal significance of consultation, the consequences faced by public administration when they violate this procedure, and how it affects the validity of administrative decisions. To navigate through these aspects thoroughly, the study is divided into two distinct parts. In the first part, we delve into the essence of consultations, setting them apart from similar terms by elucidating their concept and identifying the parties involved. Moving on to the second part, our attention is drawn to the pivotal role of consultation and its profound influence on the legitimacy of administrative decisions. Here, we shed light on the obligatory nature of public administration in seeking consultative opinions prior to making any decisions, underscoring its impact on the prudence and authenticity of these decisions. The study comes to a close, sharing a number of significant findings. One such finding highlights the steadfastness of Jordanian legislation. It suggests that if consultation is made obligatory, it transforms into a substantial and official process that the administrative authority must complete prior to making any decision. In contrast, if this obligatory consultation is neglected, the decision is deemed flawed, ultimately leading to its cancellation unless it can be justified by exceptional circumstances or urgent situations. Additionally, the study proposes that binding legislative regulations be incorporated into Jordanian law, mandating that the public administration seek consultative opinions in all circumstances rather than using their discretionary power.
