Judicial institutions at domestic and international levels have historically been male-dominated, and the inclusion of women in the judiciaries developed over time. In Kenya, before the promulgation of the 2010 Constitution, few women were appointed as judicial officers, and Justice Joyce Aluoch is one of these pioneering women. Kenya's 2010 Constitution introduced affirmative action provisions, requiring the state to take measures to make public institutions more gender inclusive. This chapter will demonstrate how pioneer women judges such as Aluoch, coupled with constitutional provisions on gender equality, have contributed significantly towards creating a gender diverse judiciary in Kenya.
