Buying groups did not play a major role in Austrian competition law in terms of antitrust law enforcement or in the academic debate. There is only a very limited number of contributions in scientific journals or newspapers about buying groups under competition law. The same also holds true for the legal commentary literature: in the relevant Austrian legal commentary literature concerning competition law, the topic of “buying groups” and “joint purchasing” is only addressed fundamentally. A profound analysis remains absent insofar as almost exclusively the European Commission’s (“Commission”) Guidelines on horizontal agreements (“Guidelines”) are used as sources by the commentators.
