Family Environment and Alternative Care Rights

The Convention on the Rights of the Child contains several articles focused on the relationship of the child within the family:Together, these articles provide a comprehensive framework for respecting, protecting, and fulfilling the rights of children in the context of their need for care, whatever their family circumstances. On the one hand, the Convention seeks to affirm the primacy of parents as the main caregivers of their children, and to require the state to meet a range of obligations to support parents in that role. On the other hand, the Convention introduces measures to render the child visible within the context of the family, imposing certain parameters on the autonomy and authority of parents in respect of the nature of direction and guidance they can provide to the child. Additional articles address the measures that are needed to protect the rights of the child when the family is unable to provide appropriate care for a child.
