Evolution in Field of Civil Justice in the Region: Perspective from the Republic of Moldova

This article discusses reforms in the field of civil justice and civil law in Moldovan territory since its independence in 1990 and underlines the specific law related to Transnistria as a region. The authors offer a brief, very broad overview over the main legal and practical aspects for civil justice, a view that is shaped by the authors’ scientific and practical experience. They provide examples of selected case-law which take a deeper view of specific legal issues in civil justice and civil law. Moldova’s judiciary history has passed through various reforms of court organization in the last three decades. The recent and ongoing developments show an approach optimizing legal proceedings, jurisdiction of courts, implementation of electronic files, new administrative procedures on confirmation of facts related to civil status recorded in Transnistria and rules on business by Transnistrian companies. Civil legislation has been reformed; evolving from the application of the Civil Code from 1964, to the adoption of the new Civil Code in 2002, and the modernization of the Civil Code in force since 1 March 2019, inspired by the DCFR and the international model rules and civil codes.
