Mental Capacity and Learning Disability

This entry aims to provide an overview of the current mental capacity issues that impact individuals with a learning disability in Northern Ireland. It will look at legal, policy, practice, and lived experience perspectives. It seeks to highlight that even with all possible support there are situations in which an individual with a learning disability, and others, is unable to make relevant decisions, and so a positive, nondiscriminatory decision-making framework is needed. Part of the rationale for focusing on this area is that it raises important societal questions about autonomy, rights, and the relationship between the state and its citizens.
