Energy Disputes in Uganda: A Legal and Institutional Analysis

This chapter examines the complex landscape of energy disputes in Uganda, analyzing their nature, causes, and resolution mechanisms within the country’s evolving energy sector. Despite possessing substantial energy resources—including 2000 MW of hydroelectric potential, 450 MW of geothermal capacity, and significant solar and biomass resources—approximately 50% of Uganda’s population lacks access to electricity, creating an environment conducive to disputes among competing stakeholders. The research explores the legal and regulatory framework governing the energy sector, anchored in the Constitution and operationalized through sector-specific legislation including the Electricity Act 1999 and petroleum laws. The chapter develops a comprehensive typology of energy disputes, categorizing them by energy source (hydropower, biomass, solar, geothermal, and petroleum) and by nature (property rights, administrative decisions, consumer protection, and investment disputes). Through detailed case studies of the Bujagali Hydropower Project and the East African Crude Oil Pipeline, the research illustrates the practical challenges in balancing infrastructure development with community rights and environmental protection. The analysis reveals key principles in energy dispute resolution, including heightened duty of care standards, natural justice requirements, and evolving environmental protection considerations. A comparative examination of dispute resolution frameworks in Kenya, Tanzania, and Ghana provides regional context and identifies best practices. The research finds that while Uganda’s specialized Electricity Disputes Tribunal represents a significant institutional advancement, gaps remain in consumer accessibility, cross-border dispute mechanisms, and regulatory frameworks for emerging technologies. The chapter concludes that effective energy dispute resolution requires strengthened institutional capacity, enhanced stakeholder engagement mechanisms, transparent compensation frameworks, and adaptive regulatory approaches that balance investor certainty with technological innovation and environmental sustainability.
