<p>The global adoption of artificial intelligence (AI) systems, such as facial recognition technology (FRT), raises pressing ethical concerns, including privacy, algorithmic bias, and the cross-border flow of sensitive data. This paper investigates the various implications of FRT deployment through a case study of Clearview AI, highlighting the challenges posed by its deployment across jurisdictions. Applying the AI Triad, which comprises of data, algorithms, and computing power, as an analytical framework, this research examines how FRT impacts cross-border regulatory dynamics. Key findings reveal significant gaps in governance mechanisms and regulatory standards, with far-reaching implications for privacy rights, transparency, data sovereignty, and ethical oversight of AI applications. This study contributes to the broader discourse on responsible AI governance by offering actionable recommendations to address these challenges. These insights aim to guide AI companies and governments in developing ethical and safe practices for the deployment of FRT and high risk AI systems generally.</p>
