The perception of Indian advocates and clients towards standard operating procedure for investigation and prosecution of rape against women
摘要
This study analyses the perspectives of Indian advocates and clients concerning the SOP for examining and handling of rape cases. The research seeks to assess the effectiveness and implementation of the SOP and pinpoint areas for enhancement. A descriptive methodology was employed using a sample of 50 participants, comprising legal professionals and clients engaged in rape cases. Data was gathered by organized surveys and individual interviews, concentrating on multiple facets of the SOP. The results underscore apprehensions over delays, inefficiency in investigations, issues in managing victim testimonies, and obstacles in delivering sufficient help for impaired victims. The findings highlight the need to strengthen victim assistance, forensic procedures, and overall procedural efficiency. Analysis indicates that delays in essential activities, such as FIR filing and medical examinations, adversely affect subsequent actions. The research emphasizes the imperative of improving the legal response to sexual violence in India.
