LGBTQ + Intimate Partner Violence Policymaking in the U.S. State Courts of Last Resort from 1965 to 2025

This paper examines litigation involving LGBTQ + intimate partner violence in the state courts of last resort, hereafter, the state supreme courts. With the notable exception of the 2022 Reauthorization of the U.S. Violence Against Women Act, this issue has been dealt with almost exclusively at the state level and courts are at the frontlines of handling it. This paper examines how the state supreme courts dealt with what was a novel concept, a state response to violence within the domestic sphere of the LGBTQ + community, and thereby shaped state level intimate partner violence policy.
