摘要

This research examines how land policies and laws have affected the Munda people of Jharkhand, India, from the era of colonisation to the present. The article delves into the ways these statutes have impacted customary tribal land law and in what way they have fallen short in protecting the indigenous people’s land rights. It examines tribal rights recognised at both national and international levels. Considering the Munda Adivasis’ forced migration from their homelands and the weakening of the Khuntkatti system, the author primarily focused on problems with the implementation of the Forest Rights Act of 2006 and the Panchayat Extension to Scheduled Area Act of 1996. To promote community engagement in forest resource management, the author highlights the vital importance of community forest rights (CFRs). The author expresses concern about the Forest (Conservation) Amendment Act 2023, which weakens the role of the Gram Sabha in tribal land governance and simplifies the procedure of forest clearances. By supporting CFRs and settling enforcement concerns, the conclusion favours Munda Adivasi land rights.
