摘要

Sand, recently designated as the New Gold, is the most extracted mineral on earth. It is a seemingly ubiquitous and indispensable resource for various industrial processes, construction, and development. Its importance lies not only in its widespread use but also in its contribution to the foundation of modern societies. However, the demand for sand has surged to unprecedented levels, thus leading to a surge in illegal sand mining activities globally, driven by its lucrative nature and the less sustainable alternatives known, with India being no exception. Illegal sand mining wreaks havoc by altering the trajectory of rivers, gravely impacting wildlife, disrupting communities, and more. The authors will narrowly focus on riverbed sand mining due to the growing instances of illegal activities on it. The paper will essentially focus on riverbed sand mining and examine the intricacies of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation & Storage) Rules, 2019, as a regulatory framework in the context of sand mining. The research delves into India’s progress towards achieving sustainable development in the context of sand mining. It evaluates the nation’s efforts to balance economic development with resource management. By combining legal analysis, environmental assessment, and a human-centric approach, the study will address the root causes of illegal sand mining, notably corruption and the influence of sand mafias. It advocates for a concentrated effort from lawmakers and the masses to combat the issue. The aim is to shed light on the gravity of illegal sand mining and propose viable solutions, including eco-friendly alternatives.
