<p>Users of an internet radio recorder can invoke the private copy exception of Sec. 53(1) first sentence Copyright Act if they make private reproductions by selecting music tracks on the service’s website and saving their track selection in a wish list, so that the service automatically records the broadcast of one of these music tracks as soon as it is played on a connected internet radio and saves this copy to the customer’s storage space, from where the customer can play back and download the music recording (upholding Federal Supreme Court, judgment of 5 March 2020 – I ZR 32/19, GRUR 2020, 7 = WRP 2020, 861 – <i>Internet Radiorecorder I</i>).</p>
