Ombudsman advice in child and youth welfare is intended to balance structural power asymmetries in the helper-client relationship, to inform young people and their families about their rights and to support them in claiming their rights. At the same time, ombudsman advice requires a high level of professional expertise and is itself characterized by a structural power asymmetry. Ombudsmanship therefore offers great opportunities to give young people in child and youth welfare a voice. At the same time there is the risk of using the excess of power and acting on behalf of those seeking advice without involving them. Specialists in ombudsman offices must be aware of existing asymmetries, negotiate transparently and balance it actively—through understandable information, explanation and self-commitment to the agreements made. In the article, the possibilities and limitations of this are illustrated using a case example. This is particularly important given the expansion of ombudsman offices on the base of § 9a SGB VIII which came into force 2021. This leads to the question how the ombudsman’s claim to deal responsibly with the existing structures can be maintained in this expansion and how young people and their families can be heard.
