Sexualität und sexuelle Rechte in Gefangenschaft: ein Vergleich zwischen Justiz- und Maßregelvollzug

For most of the people affected both imprisonment in a correctional facility and placement in a forensic psychiatric hospital mean a massive restriction of their sexual freedom. So far, this has hardly been addressed in forensic research and practice. This study explores similarities and differences in dealing with sexual behavior and sexual health between German prisons and forensic psychiatric hospitals.
A standardized online questionnaire was used to survey the heads of German prisons and forensic psychiatric hospitals regarding the regulation of inmates and patients. In total, approximately 21% of prisons and 42% of forensic psychiatric hospitals participated in the survey.
In forensic psychiatric hospitals, patients are significantly more likely to be able to have sex with external persons, use sex toys and make use of the sexual services of sex workers. In addition, the sexuality of forensic psychiatric patients is more often part of their treatment plan than it is in the resocialization plan that has to be developed for each prison inmate.
All the facilities surveyed report few written regulations on dealing with and regulating the sexual behavior and sexual health of inmates or patients. There are significantly fewer such regulations in forensic psychiatric hospitals than in prisons.
A professional discourse on the development of professional guidelines for dealing with sexual behavior and sexual health of inmates and patients appears to be equally necessary in both prisons and forensic psychiatric hospitals.
