Although the health risks of secondhand smoke are scientifically undisputed, significant gaps in the protection of non-smokers’ health, particularly of vulnerable risk groups, continue to be permitted in Germany as a result of political decision-making influenced by interest groups from the hospitality sector and the tobacco industry. This becomes clearly evident in the current example of the attempt to amend the Baden-Württemberg State Nonsmoker Protection Act, which, for the first time, involved the participation of a citizens’ forum.
