E-Scooter-Fahrten unter THC-Einfluss: Veränderungen nach der Teillegalisierung von Cannabis und der Anhebung des THC-Grenzwertes

The partial legalization of cannabis in Germany and the increase of the THC threshold for a administrative offence according to § 24a of the Road Traffic Act (StVG) on 22 August 2024 could influence driving under the influence of THC, also among e‑scooter riders, for whom data are limited.
MethodsA retrospective analysis of forensic toxicology cases of e‑scooter riders with positive findings for THC and/or THC metabolites in blood samples from the catchment area of the Institute for Forensic Medicine in Essen was conducted. Case numbers, THC and metabolite concentrations, consumption of at least two drugs (including alcohol) and time lapse between the incident and blood sampling were evaluated before and after legalization and increase in the THC threshold.
ResultsNeither the THC nor the metabolite concentrations showed significant differences between the time periods. Co-consumption was present in 43% of cases and increased significantly after legalization, without changes in the number of additional substances per case. Daily case numbers and the age of the riders of e‑scooters increased significantly after both legalization and increase in the THC threshold.
ConclusionThe results of the study showed that legislative changes were associated with an increased prevalence of e‑scooter riding under THC influence, without changes in consumption intensity or the complexity of multidrug use. Further regional studies are needed to contextualize these findings.
