摘要

The value of clinical forensic medicine in the care of victims of violence has increased, particularly considering numerous (legal) developments. Due to the inclusion of confidential forensic evidence preservation in the statutory health insurance (GKV) catalogue of services through the so-called Measles Protection Act 2020, classified as part of medical treatment under § 27 Section I p. 6 in conjunction with § 132k of the Social Security Code (SGB) V, the practical implementation required the integration of forensic medical expertise. In Lower Saxony negotiations with the statutory health insurance (GKV) were successfully concluded, based on the established Netzwerk ProBeweis structures, resulting in the recognition of confidential forensic evidence preservation as a reimbursable service. As of 1 January 2024, Lower Saxony is the first federal state of Germany to have successfully implemented statutory entitlement to confidential evidence preservation.

This article reviews the challenges and questions that arose during the negotiation rounds between the state of Lower Saxony, representatives of the statutory health insurance providers and Hannover Medical School as well as the necessary steps for forensic medicine as a negotiation partner that were derived. To ensure the sustainable establishment of forensic medicine in this area of healthcare provision, the key contractually defined agreements as well as a systematic statistical analysis of the examination numbers to evaluate the implementation success during the first year of health insurance funding in Lower Saxony, are presented. Opening this new field of work in the form of a revenue-relevant participation in healthcare provision, enables not only an improvement in the provision of care for victims of violence but also the better strategic position of (clinical) forensic medicine in further negotiations.
