In assessing criminal liability the evaluation of the effects of intoxication on a defendant’s mental capacity, in terms of judgement and self-control, falls under the expertise of medicolegal practitioners in Germany. This medicolegal evaluation pertains to the criterion pathological mental disorder, one of the 4 criteria for diminished responsibility in §§ 20 and 21 of the German Criminal Code (StGB). A two-step mixed biopsychological method is used in the evaluation. In a first step, the fulfilment of biological conditions for a pathological mental disorder is assessed. The second step follows only if the first step provides sufficient grounds to assume relevant intoxication. If this is the case, the second step, assessment of the effects of intoxication on the defendant at the time of the crime, is performed. This second step requires determination of the defendant’s actual mental capacity at the time of the crime.
